“AN ORDER ESTABLISHING A NUMBER CODING SCHEME TO REGULATE VEHICLES IN CEBU CITY DURING THE PERIOD OF ENHANCED COMMUNITY QUARANTINE”
WHEREAS, the City Government of Cebu has imposed a State of Enhanced Community Quarantine (ECQ) through Executive Order No. 064 issued on March 26, 2020, which includes 2 mandatory stay at home order for all individuals;
WHEREAS, the Cebu City Health Department has recorded a total of 161 positive cases and five deaths due to COVID-19 in the City as of April 17, 20203
WHEREAS, there'has been a sudden increase in the number of confirmed positive COVID-19 cases in Cebu City and there is an urgent need to limit and/or regulate vehicles using public roads and streets in/order to minimize persons from going around the City during the Enhanced Community Quarantine as a way to prevent the further transmission of COVID-19;
NOW, THEREFORE, I, EDGARDO C. LABELLA, City Mayor of the City of Cebu, by virtue of the powers vested in me by law, do hereby order:
SECTION 1. COVERAGE. This Order shall apply to all motor vehicles including motorcycles using public roads, streets and thoroughfares within the territorial jurisdiction of Cebu
City, unless otherwise provided herein.
SECTION 2, NUMBER CODING SCHEME. Only the following motor vehicles including motorcycles shall be allowed to use public roads, streets and thoroughfares within the territorial jurisdiction of Cebu City on the following days:

No vehicles and motorcycles allowed | Sundays
SECTION 3. EXEMPTIONS, The following motor vehicles and/or motorcycles are exempted from this Order:
1, Ambulances, fire trucks, police cars, military vehicles or other law enforcement owned/registered vehicles/motorcycles on official functions;
2. Those hired/used/authorized by the City Government for free public transportation, relief operations, delivery of goods or other purposes;
3. Those carrying person/s needing immediate medical attention;
4. Diplomatic vehicles with diplomatic plates;
5. Those owned/registered by any of the barangays in Cebu City with appropriate government plates or markings expressly showing the name of the barangay on official functions;
6. Those owned/operated/used by:
6.1 Individuals/ personnel exempt from Mandatory Stay — At — Home Order under Section 2 (A) of Executive Order No. 64, Series of 2020:
a. Medical practitioners, officers, hospital staff, nurses and health volunteers, for the purpose of rendering medical assistance and/or service.
b. Emergency personnel;
c. All authorized national and local government officials and employees;
d. Drivers and personnel of delivery vehicles of all types of cargoes;
e. Construction workers duly authorized by the City Government;
f. Accredited media personnel;
g. Farmers, fishermen and agri-business personnel;
h. Persons who seek medical attention or who are already admitted in any medical facility, provided that only one companion shall be allowed;
6.2 Government offices providing basic services under Section 2 (8) of Executive Order No. 64, Series of 2020.
6.3 Establishments who are operating under the exception of Closure of Business under Section 2 (C) of Executive Order No. 64, Series of 2020:
a. Hospitals, medical clinics and laboratories;
b. Pharmacies and drug stores;
c. Gasoline stations;
d. Cargo handlers, forwarders, shipping lines, truckers, e. Container yards;
e. Water, electricity cable and telecommunication companies;
f. Funeral parlors;
g. Establishments manufacturing medical supplies and its materials and/or components; and
h. Establishments rendering delivery "services, “whether in-house or outsourced, transporting food, medicine and other basic necessities;
i. Food establishments, provided that there shall be no dine-in customers and only takeout orders or delivery services are allowed;
j. Food manufacturers and suppliers;
k. Public ‘markets, supermarkets, groceries, bakeshops, and convenience stores;
l. Water-refiling stations;
m. Veterinary clinics;
n. Animal feed suppliers;
o. Banks and money transfers;
p. Hardware stores;
q. Delivery and courier services;
r. Dealers or suppliers of agricultural products, LPG and other petroleum products, medical supplies and veterinary supplies;
s. Laundry services.
6. 4 Wholesalers, purchasers, or kumpradors from community markets and from other local government units (LGUs), subject to proper endorsement or certification from the concerned LGU, and authorized marketgoers pursuant to the schedule imposed by Executive Order No.
069, Series of 2020.
7. Those which may be authorized by the City Mayor or his duly authorized representative.
SECTION 4. MANDATORY REQUIREMENT OF VEHICLES FALLING UNDER THE
EXEMPTIONS. Should the vehicle or motorcycle fall under any of the exemptions under Section 3, the owner and/or driver must post a written inscription of the purpose of the transport and under which agency or institution the purpose of the transport in'a conspicuous part of the vehicle/motorcycle. Further, the driver must present a company ID/personal identification card or business permit/documents proving the exemption of such person/company and shall submit the goods/cargoes transported to physical examination at the checkpoints. Failure to comply the aforesaid requirements Under this section shall be a ground to disallow passage of the vehicle/motorcycle:
SECTION 5. CONSTRUCTION. Any doubt whether or not the said vehicle/motorcycle falls under any of the exemptions shall be construed against the exemption.
SECTION 6. ENFORCEMENT. The Barangay Officials are primarily responsible for the strict and effective enforcement of this Order within their respective territorial jurisdiction. Pursuant thereto, Barangay Officials shall not allow any motor vehicles and motorcycles to use public roads, streets and thoroughfares within their respective territorial jurisdiction without having undergone proper verification/inspection.
The Cebu City Transportation Office (CCTO) withthe assistance of the Cebu City Police Office (CCPO) and other law enforcement offices/agencies, as the case may be, are likewise mandated to strictly enforce this Order and in consequence thereto, apprehend, imposed fine and/or file appropriate charges, complaints or cases against any violators pursuant to existing laws, ordinances or rules.
SECTION 7: SEPARABILITY CLAUSE. Should any provision of this Executive Order be declared by a court of competent jurisdiction as invalid or unconstitutional, the remaining provisions not otherwise adversely affected thereby shall remain in full force and effect.
SECTION 8, REPEALING CLAUSE. Any and all executive orders, issuances, rules and regulations, memoranda of the City of Cebu or any part thereof which are inconsistent with the provisions of this Executive Order are hereby repealed, amended or modified accordingly,
SECTION 9. EFFECTIVITY. This Executive Order shall take effect on 12:01 A.M, of April 20, 2020 and shall remain effective until revoked.
