EXECUTIVE ORDER NO. 5-O
Series of 2020

AN ORDER PROVIDING FOR THE ENHANCED COMMUNITY
QUARANTINE PROTOCOLS AND GUIDELINES TO BE OBSERVED
WITHIN THE PROVINCE OF CEBU

WHEREAS, on March 8, 2020, President Rodrigo Roa Duterte issued
Presidential Proclamation No. 922, which placed the Philippines under a State of Public Health Emergency;

WHEREAS, on March 10, 2020, the World Health Organization declared the Coronavirus Disease 2019 (COVID-19) health event as a pandemic;

WHEREAS, the Philippines, by virtue of Presidential Proclamation No. 929, Series of 2020, is placed in a State of Calamity for a period of six months due to the alarming rise of COVID-19 cases in the country;

WHEREAS, on March 25, 2020, the Governor of Cebu declared the Province of Cebu under a state of Enhanced Community Quarantine;

WHEREAS, on March 26, 2020, and in an emergency session, the Cebu Provincial Board declared the Province of Cebu under a state of calamity;

WHEREAS, Section 3 of Republic Act 11332, entitled “MANDATORY
REPORTING OF NOTIFIABLE DISEASES AND HEALTH EVENTS OF PUBLIC HEALTH CONCERN ACT,” expressly empowers the public health authorities to declare quarantine, isolation, and rapid containment measures for disease prevention and control;

WHEREAS, Republic Act (“RA’) No. 7160, otherwise known as the “LOCAL GOVERNMENT CODE OF 1991,” states that provinces shall exercise powers necessary, appropriate, or incidental for its efficient and effective governance and those which are essential to the promotion of general welfare, health, and safety, including the provisions of services to control communicable diseases;

WHEREAS, under Section 465 paragraph (b)(1)(vii) of the Local Government Code, the Provincial Governor shall carry out such emergency measures as may be necessary during and in the aftermath of man-made and natural disasters and
calamities;

 WHEREAS, there is an urgent need to provide for guidelines and protocols to be observed during the period of the enhanced community quarantine;

NOW, THEREFORE, I, GWENDOLYN F. GARCIA, Governor of Cebu, and
by the virtue of the powers and authority vested in me by law, and congruent with my previous executive orders, do hereby order the observance of and compliance with the following guidelines and protocols during the period of ENHANCED COMMUNITY QUARANTINE, to wit:
SECTION 1. DEFINITION OF TERMS.

a. Enhanced Community Quarantine refers to the level of
community quarantine where a twenty-four (24) hour strict home
quarantine shall be implemented in all households within
specified geographic boundaries, transportation shall be
suspended, provision for food and essential health services shall
be allowed but regulated, and a heightened presence of uniformed
personnel to enforce quarantine procedures.

b. Enhanced Community Quarantine Pass (ECQP) refers to the
pass given to residents of a Local Government Unit (LGU) that
restricts and monitors their movement. It authorizes them to
leave their residence to purchase food and other necessities but
restricts and monitors their movement.

The Quarantine Pass shall bear the signature of the Local Chief
Executive (LCE) concerned and a control number regulated by the
Provincial Government of Cebu.

c. Vehicle Quarantine Pass (VQP) refers to the pass given to
residents of a LGU that authorizes their vehicle ~ car, SUV, pick ~
up, vans, motorcycle - to travel around the Province of Cebu. The
purpose of the travel is limited to the their travel to and from
work and the purchase of food and other necessities.

The Vehicle Quarantine Pass shall bear the signature of the LCE
concerned and a control number regulated by the Provincial
Government of Cebu.

d. Household shall refer to a social unit consisting of a person living
alone or a group of persons who sleep in the same housing unit
and have a common arrangement for the preparation and
consumption of food.

SECTION 2. MANDATORY HOME QUARANTINE FOR ALL
RESIDENTS. All residents of the Province of Cebu shall be placed
under home quarantine at their residences in order to reduce the
risk of exposure to and transmission of the COVID-19. To this end,
no one is allowed to leave their residence EXCEPT:
I. Medical Services
a. All DOH officials and staff
b. All health and service personnel stationed at LGU health
facilities
c. All Philippine Red Cross (PRC) vehicles bearing the PRC
logo and staff with PRC IDs
d. Core staff from the World Health Organization (WHO) and
their regional offices
e. Doctors and their drivers
f. Hospital staff, administrative employees, and janitors
g. Medical Professionals and other employees
h. Private caregivers

Funeral Services

a. Funeral parlor employees
b. Immediate family of the deceased imams, pastors, and other religious
c. Officiating. priests, ministers

At any given time, excluding direct family members, there
should only be ten (10) persons in the funeral service.

Strict social distancing shall be observed at all times.

- Medical products such as PPEs, masks, gloves, and others
- Construction materials for infrastructure projects
c. Employees of the following:
- Hardware stores
- General merchandise and textile stores.
d. Subject to the restrictions of Section 6, construction
workers in construction or project sites

Vl. Utilities

a. Officials and employees of telecommunication companies
b. Employees of cable or internet service providers and their third-party contractor
c. Energy Companies
- Electric power generation, transmission, and distribution employees
- Exploration, coal operation, trading employees, and delivery drivers
- Third-party contractors
- Petroleum tanker drivers
- Gasoline attendants
- All energy related work force, including those who perform indirect services such as security, technical, and other personnel as certified by the energy agency or company
d. Officials and employees of water companies
e. Employees and crew of water delivery and refilling stations
f. Sanitation
- Industrial, residential, hospital, and toxic garbage or
waste collectors and drivers.

VI. Other Authorized Persons.

a. Government officials
- Officials of the national government
- Officials of national government agencies
- Ombudsman and Deputy Ombudsman
- Justices of the Supreme Court, Court of Appeals, Court of Tax Appeals, and Sandiganbayan
- Judges of the regional, metropolitan, city, and municipal trial courts

- LCEs, vice mayors, and councilors
b. Employees of the LGUs
c. Persons in the Media duly accredited by the Provincial
Government of Cebu
d. Agribusiness and Agricultural Workers
- Farmers, farm workers, fishermen
- Employees of agricultural supply stores and outlets
- Veterinarians and employees of veterinary clinics
e. Officials and employees of business process outsourcing companies, provided, they shall reduce the in-person workforce reporting at any of its work locations, branches, or offices by 50%.
f. Officials and employees of export-oriented businesses
g. Outbound domestic and international passengers
h. aviation related service personnel
- Pilot, crew, and ground personnel
- Air traffic service personnel and other personnel of the Civil Aviation Authority of the Philippines
- Airport personnel who will perform other airport functions at the Mactan-Cebu International Airport
- Officials and employees of the Mactan-Cebu
International Airport Authority
- Officials and employees of GMR Megawide Cebu Airport
Corporation

i. Ship captain and crew

j. Members of the diplomatic corps such as consuls and ambassadors

k. Persons with a pre-existing medical condition that necessitates treatment in a medical facility. A certificate from the LCEs of the LGU having jurisdiction over his or her residence must be secured as well as a medical certificate.

Persons involved in accidents and medical emergencies.

One (1) member of the family or household and a driver
may accompany said persons.

l. One (1) member of the family or household under home quarantine who will be assigned a ECQP (Section 3 of this order) by the LGU having jurisdiction over their residence. The assigned household member shall be allowed to leave his or her residence only for purposes of purchasing food, medicines, groceries, and other necessities.

A household is allowed to purchase food and other essential goods pursuant to the parameters set forth under Provincial Ordinance No. 2020-06.

m. All other employees of those mentioned in Section 3 of this
Executive Order. :

Employees of other businesses may be exempted as determined and approved by the Provincial Governor.

SECTION 3. REGULATION OF BUSINESSES. To further regulate
the movement of persons within Cebu. The establishments below
mentioned are directed to observe and comply with the following
orders during the period of the enhanced community quarantine, to
wit:

I. The following establishments engaged in the following essential
services shall remain open without restriction:
a) Hospitals, health clinics, diagnostic centers, laboratories and
other health care related offices;
b) Those providing or manufacturing basic necessities such as
food, medicines, pharmaceuticals or those essential materials
for the preparation or manufacture of basic necessities;
c) These manufacturing hygiene products (soap, rubbing alcohol,
hand sanitizers, detergents, diapers, feminine hygiene
products, tissues, wipes, toilet papers and disinfectants);
d) Energy, water, telecommunication and other utility
companies;
e) Construction companies, suppliers of construction materials
and other construction related services;
f) Companies engaged in the production of cement;
g) Shipbuilding companies;
h) Airports;
i) Seaports;
j) Manufacturing and processing plants of basic food products
and medicines:
k) Public markets;
l) Slaughter houses;
m)Super-markets and groceries;
n) Commissaries;
o) Cold Storages;
p) Pharmacies;
q) 24/7 convenience stores;
r) Hardware Stores;
s) Bank, remittance centers, ATMs, puwnshops, and other
financial institutions;
t) Power, energy, telecommunication. cable/internet, and utility-
providers;

u) Veterinary and Animal Feeds Vendors;
v) Newspaper, radio, TV networks, and other similar media outfits;
w)Gasoline stations, petroleum, LPG stores, and legitimate
butane suppliers;
x) Trash collection and services necessary to maintain the safety,
sanitation, and essential operations of residences;
y) Logistics, technology support, and child care services;
z) All other businesses that may be classified as essential by the
Governor.

II. The following establishments engaged in the following essential
services may remain open from 8am to 5pm:

a) Water refilling stations;
b) Laundry services;
c) General merchandise stores selling some essential goods;
d) Suppliers of aggrieves and feed suppliers.

However, the transport of feeds and aggrieves within the
Province of Cebu is without restriction.

III. The following establishments engaged in the following essential
services may remain open until 9PM:

a) Subject to existing protocols, only take-out, drive-thru, and
home delivery shall be allowed in restaurants, fast food
chains, pizza chains, food stalls, eateries, and carenderias;
b) Ambulant food vendors shall not be allowed;
c) Bakeshops;
d) Sari-sari stores;

IV. Hotels and other similar establishments may continue to operate
subject to the restrictions under Executive Order No. 5-L, Series
of 2020. Restaurants in hotels shall close at 9 o'clock in the
evening and only room service shall be allowed.

V. Business Process Outsourcing, Knowledge Process Outsourcing,
non-profit entities, and export-oriented industries within the
Province of Cebu may remain operational provided they utilize, to
the maximum extent possible, any telecommuting, work from
home, or alternative work arrangements. They shall reduce the
in-person workforce reporting at any of its work locations,
branches, or offices by 50%.

VI. Funeral parlors, funeral homes, mortuaries, morgues, and
cemeteries

Wakes and funeral services shall be allowed subject to the
observance of strict social distancing.

At any given time, and to the exclusion of the immediate family
of the deceased, there should only be ten (10) persons present in
the vicinity of the wake or service. The persons visiting the wake,
except the immediate family of the deceased, shall apply for a
special quarantine pass from their LGU which shall be valid only
for one visit.

Strict social distancing shall be observed at all times.

LCEs are charged with the duty of ensuring that these protocols
are strictly followed.

All establishments that are allowed to remain open shall strictly enforce social distancing measures, such as, but not limited to, skeletal staffing, temperature checking, use of masks and gloves and other requirements that may be implemented by the Cebu Provincial Government.

SECTION 4. NON-DISRUPTION OF GOVERNMENT WORK.
Essential government offices providing health and support services
during the COVID-19 pandemic shall continue their work. The
following shall be observed:

A. The Cebu Provincial Capitol of Cebu and the different LGU within
Cebu will remain open and shall maintain their operations with a
skeletal force to guarantee the continuity of vital and essential
services.

Access to the different offices of the LGUs shall be limited and
controlled by enforcing social distancing and other measures.

B. The sixteen (16) provincial and district hospitals, the Provincial
Health Office (PHO), the rural health units, barangay health
centers, the Provincial Risk Reduction and Management Office
(PDRRMO), the Provincial Social Welfare and Development Office
(PSWDO), and the Provincial Environment and Natural Resources
Office (PENRO) shall continue to operate and maintain full
deployment of their personnel.

Other offices subsequently declared by the Provincial Governor as
essential shall observe the parameters of this order.

C. Visitation of detainees in the Cebu Provincial Detention and
Rehabilitation Center (CPDRC) are hereby suspended.

Relative thereto, no additional detainees shall be accepted to the
facilities.

SECTION 5. PUBLIC MARKET AND SLAUGTER HOUSES. All
public markets and slaughter houses within the Province of Cebu
shall remain open and fully operational provided that strict social
distancing is observed by vendors, loaders, and goers.

LCEs are charged with the responsibility in ensuring the compliance
by Public Markets with this directive.

Depending on the size of a public market, LCEs shall limit the
number of persons within the vicinity of a public market at any given
time.

As far as practicable, LCEs shall encourage the delivery of food,
groceries, and other necessities where services of tricycle and habal-
habal drivers may be engaged.

LCEs are further encouraged to set up and operate mobile markets
within their jurisdiction

SECTION 6. CONSTRUCTION PROJECTS. Companies who have
on-going construction projects within the Province of Cebu shall
ensure that their workers observe strict social distancing at
construction sites. They shall regularly check the health and well-
being of their workers.

These companies are required to provide bunk houses for workers
living outside of the municipality or city where the construction site
is located.

Except for workers residing within the LGU where the construction
project is being undertaken, the movement of workers shall be
restricted to their bunk houses and the construction site.

Construction workers in construction sites located within the City of
Cebu but residing in the Province of Cebu shall be confined to the
project sites of said city.

SECTION 7. ENHANCED COMMUNITY QUARANTINE PASS. LGUs,
thru the different barangays, within the Province of Cebu, shall
conduct a profiling of their constituents and their households.

Subsequent thereto, the concerned LCE shall then issue an ECQP to
a qualified household member.

Only (1) quarantine pass shall be issued to each houschold. The LCE
may issue an additional ECQP upon a written request for justifiable
reasons.

No fee shall be charged for the issuance of a ECOP.

The ECQP shall be presented to the personnel of the PNP, AFP,
Barangay Officials, and other government security personnel
manning checkpoints or on patrol every time a household member
leaves their residence for purposes of purchasing food, groceries,
medicines, and such other acts allowable under this executive order.

For all personnel employed under businesses qualified as essential,
it is sufficient for them to present their identification cards, in lieu of
the quarantine pass, in the checkpoints. Law enforcement personnel
‘enforcing the quarantine shall require the presentation of the ECQP
from persons found outside of their household.

The ECQP must be carried by the assigned person at all times.
Establishments shall require the presentation of the ECQP before
transacting with the individual.

SECTION 8. VEHICLE QUARANTINE PASS. LGUs shall issue a
VQP that shall be honored within the territorial jurisdiction of the

Province of Cebu. The VQP shall have a centralized color coding and
control number assigned and supervised by the Provincial
Government of Cebu.

Subject to the restrictions under Section 16 and 17 hereof, vehicles
with a VQP shall be granted access to all LGU within the territorial
jurisdiction of the Provincial Government of Cebu.

Only one (1) VQP shall be issued per household. The LCE may issue
an additional VQP upon a written request for justifiable reasons.

No fee shall be charged for the issuance of a VOP.

Government vehicles with red plates shall not require a VQP
provided that those onboard have the proper passes. For other
Government vehicles, they shall be issued their own vehicle pass.

Ambulances may travel unimpeded within the Province of Cebu
without the need for a vehicle pass.

SECTION 9. ASSISTANCE AND SUPPORT. The Provincial
Government of Cebu thru the different municipalities and
component cities shall regularly provide assistance and support to
its constituents.

To this end, there shall be a prioritization on the extension of
assistance and support in the following order:

a. Indigents and those living below the poverty line
b. Displaced workers
c. Senior citizens with no other means of income

d. Those under mandatory quarantine without any
financial means.

As far as practicable, LCEs, thru their Barangay Captains, shall
have such support and assistance delivered to the households of
their constituents. Gathering of beneficiaries in order to distribute
said assistance is strictly prohibited.

SECTION 10. SUSPENSION OF PUBLIC TRANSPORT. The operation of all forms of public transportation within the Province of Cebu is hereby ordered suspended during the period of enhanced community quarantine.

Passenger and cargo sea vessels operating within the territorial
jurisdiction of the Province of Cebu shall not be covered by this
suspension.:

Except for hospitals, all business establishments allowed to operate
under Section 3 of this Executive Order shall be required to provide
transportation for their workforce.

LGUs are encouraged to provide transportation for front liners,
health and medical workers, within their territorial jurisdictions.
They are also encouraged to provide transportation arrangements
for residents who do not have private vehicles and who need
to. leave the house to buy food, medicines, or other essential transactions or procedures.

SECTION 11. UNRESTRICTED MOVEMENT OF CARGO. There
shall be no restriction on the movement of any and all cargo within
the Province of Cebu during the period of the enhanced community
quarantine.

Basic and essential goods and other necessities shall be given
priority over other goods. There shall be no collection of
unreasonable charges or fees that would hinder or burden the
movement of essential goods and basic commodities.

SECTION 12. DEPARTMENT OF TRADE (DTI) STICKER. Pursuant
to applicable DTI Memorandum Circulars, the DTI shall issue DTI stickers to the trucks and vehicles of enterprises and establishments
‘engaged in the manufacturing, buying and selling, and transporting
of essential goods. These stickers shall be sufficient proof of the
essential nature of the goods being transported.

Companies requiring DTI Stickers shall course their requests thru
the LCE of the LGU where their head office is located.

Inthe meantime, the LCE of the LGU
where the head office is located shall issue temporary passes for
cargo trucks and other vehicles carrying essential goods.

SECTION 13. ADDITIONAL FACILITY FOR PERSONS UNDER
MONITORING. To supplement the facilities for Persons Under
Monitoring (PUM) in the different local government units, public
‘school facilities shall be made available to the LGU for containment
and security measures during this crises.

SECTION 14. ENFORCEMENT AND BORDER CONTROL. There
shall be a twenty-four (24) hour checkpoint in every entry and exit
point of every municipality and component city of the Province of
Cebu which shall be manned by security personnel from the
Philippine National Police, Armed Forces of the Philippines, LGU’s
Disaster Risk Reduction Management Office, and other security
forces of the Philippine Government.

SECTION 15. PROHIBITION ON ENTRY. Effective 12:01 AM of
MARCH 30, 2020, no person shall be allowed entry into the
territorial jurisdiction of the Province of Cebu as defined by the
borders of the City of Mandaue in the North, the City of Talisay in
the South, the Municipality of Balamban in the West, and to include
the Municipality of Cordova in the island of Mactan.

The following are exempted from this restriction, to wit:
a. Provincial Governor, Vice-Governor, and Board Members.

b. Justices of the Supreme Court, Court of Appeals, Court of Tax Appeals, and Sandiganbayan

c. Ombudsman and Deputy Ombudsman

d. Congressmen from the Province of Cebu, the lone district of

e. Lapu-Lapu City, and Cebu City

f. Judges and skeletal workforce of the regional, metropolitan, city ,
and municipal trial courts

g. Regional and provincial directors of the different national
government agencies

h. Local Government Officials

i. Members of the diplomatic corps such as consuls and
ambassadors

j. Employees of the Provincial Government of Cebu

k. Employees of the municipalities and component cities of the
Province of Cebu as authorized by the Local Chief Executive

l. Prosecutors and the skeletal workforce of their offices

m. The skeletal workforce of other government agencies

n. DOH officials and staff

o. Private and government doctors, nurses, and other medical
personnel

p. Hospital workers, administrative staff, and janitors

q. Members of the Philippine Red Cross but only for official functions

r. Media Personnel accredited by the Provincial Government of Cebu
Members of the PNP, AFP, and other security personnel

s. Field personnel of the Visayan Electric Company

t. Field personnel of the Metropolitan Cebu Water District

u. Field personnel of PLDT, Globe, Smart, Sun, and other telcos

v. All energy (electricity, fuel and petroleum) related work force,
including those who perform technical services

w. Officials and employees of banks and money transfer establishments

x. Delivery personnel of vehicles carrying cargo and other essential
goods with or without load (maximum of two (2) including driver)
subject to the observance of strict protocols

y. Persons with a pre-existing medical condition that necessitates
treatment in a medical facility. A certificate from the LCEs of the
LGU having jurisdiction over his or her residence must be secured as well as a medical certificate.

Persons involved in accidents and medical emergencies.

One (1) member of the family or household and a driver may
accompany said persons.

An exemption from this restriction by the Provincial Governor of
Cebu upon for justifiable reasons upon presentation of a written
request.

SECTION 16. HARMONIZATION. This Executive Order shall be
read in harmony the previous executive orders issued by the
Province of Cebu relative to the COVID-19 pandemic.

SECTION 17. APPLICABILITY. This Executive Order shall apply to
the cities of Mandaue, Talisay, Naga, Carcar, Toledo, Bogo, Danao,
and the forty-four (44) municipalities of the Province of Cebu.

SECTION 18. EFFECTIVITY. The protocols and guidelines for
Enhance Community Quarantine under this Executive Order shall
take effect on MARCH 30, 2020 at 12:01 AM.

SO ORDERED.
